A HC plate owner who has since rented his taxi plate out, [HC regulated plates] he has gone over the border to a different council [unregulated plates] and obtained other council HC plate and works that area

He now has 2 plates, one from each council, plus he will also have 2 HC licences, as far as I am aware this is illegal, it is thought each council will have no idea or knowledge of this, your thoughts

I don't think it is illegal.

Some councils have by-laws saying you can't have a free plate (in a restricted area) if you have had one elsewhere, but I doubt that would stand up in a court of law.

A person can have as many plates in as many areas as they wish. There is no law on the statute that says they can't.

Nothing illegal about having plates in different areas, but if he's renting it out (ie doesn't actually operate the taxi) then he's probably in breach of the rules.

dont those car hire firms licenbse the same car in various different councils.
i think they even license them as cabs in open districts and ph in closed.
anyway there must be money in it because many firms now offer the service.
bloke down here who does all the bodywork has about six ph he uses.
I think he chargees the insurance firms £75 a day.
not bad £525 a week rent for a £2,000 motor.

Why was it many years ago when I changed from one licence authority to another, the ex copper LO stood over me and said if you don't hand over the old other authority taxi licence badge [still in force] you ain't going to get this taxi licence authority taxi badge, your deal, he said, give it to me or you don't get this one, you can't have two.

I take it at the time you weren't aware that only the committee can refuse you a license? The LO has nothing whatsoever to do with refusing your application unless of course you didn't supply all the necessary information at which point the license might not be granted until you had supplied the correct information.

Your experience from the past has nothing whatsoever to do with the law. I take it you now know that.

No I was not aware, but years have rolled on and I now start thinking.
many years ago in Devon [1965 whilst a junior soldier]I got pulled over for speeding on a motor bike just after passing my motor bike test on the Newton Abbot Road to Torquay, the cop car pulled me over and said hey you was speeding, yes officer I was, ok said the police officer, here is a summons, thank you officer, thinking back, hey, he had no proof but I paid the summons, same applies to the taxi licence, I did not know what I could or can do at the time.
