Post subject:  Central Trains Station Contract

Just collected the new contract, due from 1st. April.

Contains the following clause:-

WHEREAS:-

(A) The object of the Taxi Operator(s) taxi cab business is (inter alia) to supply and maintain licensed mini cabs to be available at LINCOLN Station for the use of passengers arriving at the said station.

(B) The Station Owner has agreed to permit licensed mini cabs operated by the Taxi Operator to ply for hire at their said station, LINCOLN.....

"TAXI" means a vehicle licensed by the City Council as a licensed mini cab or Hackney Carriage and/or owned by the taxi operator.....

3.4.1 Taxi and motor vehicle Law; the Town Police clauses act 1847 and 1899, Local Gov. Misc Provisions Act 1976.....

15.6 This agreement shall be governed bay (sic) and construed in accordance with English Law.


Well, it's nice to know their legal department is up to speed on law regarding plying for hire.... :shock: :shock:

I'll spread this news amoungst my touting friends I'll see this weekend, then they can all head North and work Lincoln Station.

So presumably they're assuming that the rank is on private property thus PH can ply for hire?

Presumption and assumption aside, a station taxi rank is a public place, irrespective of whether or not it is private property. (and Lincoln Station Forecourt is NOT private property) I have been informed that the contract interpretation of "mini-cab" is a saloon type hackney carriage. I informed central trains that was unneccessary, either a vehicle is a licensed hackney carriage, or it is not. No grey area (despite many ph drivers believing they are driving a taxi).

But, leaving aside the Lincoln scenario, isn't it the case that a station rank could be deemed a private place and thus PH cars could ply for hire?

Wasn't that the conclusion in the Eastbourne case, although not necessarily applicable to the facts of the case itself?

It all depends on whether that chap on the London bus can see the rank from a public place, and is attracted to it.

But of course that law doesn't apply in Watford, for whatever reason. :-k

Well if it's on private property, and with the owner's consent, then I think the can :-k

It certainly happens at one or two airports as far as I know, but no doubt while in theory it's permissable in law, in practice there are very probably scenarios that could be challenged in court.

All providing there is a record of the booking back at the office this constitutes a prebooked PH fare, that's it in a nutshell, where ya going guv whats ya name, I will just call the fare through to the office before we set off.

Not a practice I subscribe to by the way but none the less very common.

I doubt a driver could be done for illegal hiring in that case. Maybe illegal plying. :?
