I received an email yesterday, as did all other drivers in our district from a company called Taxiplus to inform us that they had been appointed by our Council to conduct DBS and drivers license checks for the Council.
This was the first that any of us had heard about this and we are not happy with our personal data being disclosed to this 3rd party company.
A few minutes ago I checked my DBS online and it was checked by this company on the 21st June without my knowlege or consent.
Would this be a data breach.

I think that depends on what document you signed when this was originally set up if the T & C's say you authorised the council or any 3rd party operating on their behalf then probably not; however if you did not sign any such document...

I have checked the email that was sent out in January and there is no mention of 3rd party authorisation. Now if there was a form that I filled in I can't remember but I certainly would not have knowingly agreed to this.

I have just checked the information that I sent to them and it was just a reply to their email that has no mention of 3rd parties.

When you agreed that the council could check your details, did the request also say 'and agents of the council'?

All that said the council should inform you about any change before it happens, not afterwards.

Then best you ask them who approved the change, why license holders weren't informed prior, and was the council's data protection officer involved.

Funny, that - by some coincidence it was TaxiPoint and TaxiPlus that yesterday launched the 'groundbreaking' national taxi and private hire survey.

Which funnily enough represents a good opportunity to harvest drivers' email addresses and other personal information, such as what kind of car they drive, annual mileage etc 8-[

Did have a look at their website yesterday, and did notice the DBS stuff, but didn't really think that much about it, if only because we don't have the DBS system up here.

But they've got a page with a long list of the councils they work with, including B&H and Melton :-o

The data protection officer is involved now. I reported it as a data breach and he has been in touch and asked me to send him the details, which I have.

According to the Taxilplus website, they never see your DBS certificate. They can only check to see if there has been a ‘status change’ in which case you’ll be asked to apply for a new certificate which will be sent direct to yourself and you then show it to your LA. I still wouldn’t be happy with any of my information being shared with a third party without my consent.

It does beg the question as to why councils can't be sent status changes, or more to the point why can't they be arsed to deal directly with status changes.

Very much doubt Taxiplus are doing it for SFA.

They are also going to be checking our drivers license. Now at the moment I have to generate a code and send this to the Council. The Council say that this company has been authorised to do this for 3 years and it will save use drivers the hassle of getting the code ourselves. However in order to generate the code requires my National Insurance Number so with this and my drivers license number anyone can steal my identity.

Strangely enough, my insurance offered to do the DVLA check for me this year (if I provided the required Personal information) to save me the time and hassle. I politely declined and sent them the code myself.
