Can a Hackney driver who has his badge and vehicle license in one area where UBER does not hold an operators license work for UBER using the same badge and license in another area where they do have an operators license for instance using a badge and license issued by Melton Borough Council to work for UBER in Leicester?

I don't like it, but I think yes.

A Hackney (Driver and Vehicle) is PH anywhere, and the UBER booking is, in effect, PH.

I would say yes unless his home council requires him to work within his licensing area predominantly. An increasing number of councils now require that confirmation when re-licensing.

He could also be viewed as plying for hire in any area that he isn't licensed in.

I would also caution hackney drivers, doing as you say above, over what they charge. They must have an agreement with the person who books if the fare exceeds the home tariff. I'm not sure a Uber booking can be classed as an agreement, given Uber is the principal and sets the fare, not the driver, as stated in the acts.

I'm also surprised Uber is inviting hackneys to their app, given the issues with pricing.

But can WORK as a PHV via any PH base in England or wales unless, as stated, its LA has the "intended useage" caveat in its policy
