I need some sound advice, back in April this year on officer of Bolton council issued a plate to Mann and Overton.

There is a limit on in Bolton This officer did not ask the council members did not consult with the trade, this plate was to be use as a replacement for repairs, in Bolton we have a age limit 10years on 15 off, the officer said that the vichlie sould be not less then 3 years, We object to the issue of this plate being issued.

the council members when this matter was put beforwe them Refused to grant, but mann and Overton was not invited to the Committee.

It as been to couirt twice and adjourned, the council solicitor asnow side he feels that the council would loss, and the matter sould go back to committee for re-consideration.

This for us is De-limiting by the back door, now the council member may again refuse againg but we are asking why is it agoing back any way

is there any one who could put some light on this. what can we say to the council solicitor who we think is runing scared and looking for a easy way out.

If the council has a policy of restricting numbers to X, then they would need a committee of sorts to change that policy to X plus 1.

I'm assuming that the council issued the plate to M&O for them to use as a spare for drivers when their vehicles are in the work-shop. I think that's a great idea. I remember one of the Medway/Essex councils does like-wise.

Alas the plate they issued M&O, IMO, is as valid a plate as the one you and your colleagues drive. So the council have issued a plate to a firm rather than to a licensed driver. Not very impressive. :sad:

Can the council take it back, I doubt it, and maybe the Royden case backs up M&O. Perhaps we should all open garages and apply for these type of plate.

So the situation the council doesn't have any outs, again IMO, they just messed up big time. :shock:

The council should just issue a temporary plate to M&O's vehicle.

I know of a restricted area up here where temporary licenses are available where a vehicle is tested but in order to be plated the plate attached to the vehicle in for repair must be returned to the council for safekeeping. When the vehicle being repaired is ready again for use, the temporary plate is exchanged for the permanent one.

It seems to work well.

Isn't Bolton affiliated the NTA? Perhaps it might be wise to ask them? Let us know what they say?

Yes we are I am also the secretary of region 5 NTA.

The point was as any body out there had the same problem what is are problem to day may be there tomorrow, what is clear is that when to ask any thing about Mann and Overton you dont get meny replies its like pepole dont want to upset them, I think they are trying to de-limit by the back door.

Well all of the above doesn't preclude you from asking the NTA does it? I thought you wanted to know the legality of what Bolton are doing? Are the NTA not best placed to tell you that?

What is their purpose ??????????????????

It appears that you don't fully understand the format of the organisation or its function.

But there again you'd prefer just to make something up.

I don't think there is any ambiguity on this site of those persons who like to make things up. We just had a sample of your make believe, in the thread regarding surveys.

Just for your information the NTA policy states as follows.

to assist its members in all and every way possible.

Now I don't know what spin your going to put on that NTA policy statement but you might reflect that the Bolton rep asked for "advice". If he can't get any advice or assistance from the NTA, then perhaps he should think about joining an organisation that will give him advice and assistance

the resion I asked on here was to see what if anything other have done if they have had the same, you could ask the GMB T&G AND NTA, and you may or may not get the same answere, its the passing of information and problems that give us the best chaces to deal with the meny issues we deal with.

We all do whats best for the area, we are in now what is good for one may not be good of others, so i will get as much information as i can then make up my mind what to do.

The NTA is more than help full, in these matters but its up to the association to help them selfs i best pual and wayne gets fed up me ringing,

I'm not lingering on your wisdom of asking for help in this forum, I merely asked what response you had received from the NTA, if any? I take it from your response you haven't asked them?

Considering we have many NTA members who frequent this site perhaps they can supply the information you require without you having to resort to a costly telephone call.

The NTA policy statement says its purpose is......

to gather, organise, keep on file and diffuse useful information;

Was there any reason for you to believe that you thought even though the NTA keeps on file useful information that it might not be in possession of the particular information you were seeking? Is there any point of belonging to an organisation if you don't think they are up to the job of advising you on such matters?

Bolton is a classic example of Derek Cummins Wanna Plate and Gorra plate scenario and I suppose many of these carpetbaggers are in your association trying to stop others from getting the exact same as what they got?

I dont think the NTA have been asked.

I dont think telephone calls are costly, because email is usually used.

I think if the question were asked to anyone, and they didnt like the answer they got, they would question the answer (if the question were asked).

The association are surely asking the legitimacy of a LA issuing a license?

Nice of you to respond but I wonder why the rep from Bolton didn't seek advice from the NTA especially considering that this particular incident happened way back in April 2006? Why did he wait until now to bring it to the attention of this site?

Surely it doesn't take seven months to find out if the decision by the council is kosha?

JD,

you know and I know, if a LA limits numbers... it limits numbers.

If an LA were to issue 1 further license in a limited numbers scenario, questions would be raised about further applications.

I am certain the rep from bolton will raise this issue with the NTA during the next few days, and since he raised the issue here, I suppose he'll give you the NTA answer.
