Post subject:  carriage of children seated in pushchair
Does anyone know the Law regarding the carriage of children in pushchairs in Taxi /Private Hire vehicles, it's becoming increasingly popular for parents to request that their child stays seated in the pushchair whilst travelling in a WAV. It seems that Buses allow this practice, but what is the Law on this??

The new legislation on child restraints contains a blanket exemption for taxi & private hire vehicles when working.

Any member of your association that wishes more information can go to www.thinksafety.gov.uk which contains Frequently Asked Questions and answers which they can print off and keep for their own benefits.

If a vehicle has a booster seat fitted then best practice would indicate that it should be used but if none is fitted as standard then the basic rule is taxis and PHv's whilst working are exempt.

I think all the time nothing happens then your council will be fine.

When something bad does happen your council will not be fine.

What I would do is to ask your council for their legal view, and if that comes back saying they don't think it's safe, then put that up in the cab to cover your bum. :wink:

About 10 years ago Ashfield Council threatend to drag us in if we put children in pushchairs into the cabs, the LO at that time Jim Mortell was harping on about how unsafe it was with the puschairs not being secured.

I fully agree that it is not safe practice, I have requested an answer in writing from a legal source, this is not my practice, but something is needed in "black and White".

dundee council policy allows cabs with a screen between the driver and passenger(txs ,e7s)etc to carry prams with the child in place, without a screen its a total no go, even the very powerfull dwta has warned members if you break the rule and dont have a screen there is nothing we could do for you
