Post subject:  wife driving hackney with no license

my wife was allegedly seen driving my hackney carraige with no topsign or plates now the council want to do her under the tpa 1847 any thoughts on this subject as they have tried to "do" me already but failed miserably for the same "offence"

First, one assumes the hackney carriage was licensed at the time she was alleged to have driven it?

Second, one assumes that the person who thought they saw your wife driving the vehicle has evidence to prove that fact.

While the vehicle is licensed as a hackney carriage, under most circumstances driving without a plate and a top sign is a breach of licensing conditions.

If the only evidence is hearsay evidence then depending on the person’s credibility it may well be accepted by a licensing committee but not necessarily by a court of law.

th person who alledges that she see my wife driving is the local taxi enforcement officer she says she is trying to do my wife for being an unlicensed driver even though she has already tried nicking me for it but failed miserably

Anyone else see this or just the taxi enforcement officer? You say the taxi enforcement officer tried to do you with the same thing? Does she have a grudge against you? Which council licences you?

If she isn't licensed then she shouldn't be driving it.

And you as man of the house should put your foot down and tell her who's boss. :wink:

Many cab garage owners drive the vehicles down here but don't hold a HC/PH license.

They quite often drive the vehicles when taking them for test or after carrying out work.

Why does someone have to hold a license to drive a HC/PH if they arent working it?

I maybe wrong here,but i am sure that a non badge holder can drive a PH but not a HC.

I apologise Mr T but i should have stated the fact that this is the way our council operates.

The sooner we have a set of rules for the whole country, the better :)

Without clear evidence like a pic, or actually stopped her whilst driving the car (only a police officer in uniform can do this) as has been said it's hearsay.
The correct way would be to suspend the plate when she's using it, but then you'd need a normal MOT as well.

What do you mean a normal MOT as well, surely all vehicles need a normal MOT once they are 3 years old. We have to produce ours with the registration document and insurance certificate to get our plates.

A taxi is always a taxi.

The fact that the driver isn't working at the time dosen't stop it being a taxi.

Only people legally allowed to drive taxis without a license are folks testing any repairs made to that taxi. :wink:

Has she been interviewed? Have you been interviewed? It ain't hearsay by the way its what the EO says he has seen. Let them prove it, deny she was driving, demand an ID parade and the council will duck out cos they haven't got a clue. (Is the EO ex-old bill?)

yes the l.o does hold a grudge against me mainly because i won't kiss her butt when she says so we are actually building an harrassment charge against her due to her completely petty behavior over the past year incidentaly she is due to leave soon and has been heard to say she wants to "go out in a blaze of glory" she has been "nicking" drivers left right and centre on petty charges for months now and me and my business partner are not prepared to take this laying down also when she alledges my wife was driving the car was parked at my mum and dads house with her standing by it (wife) i happened to be in switzerland at the time, regards
