How many people realise that passengers can be prosecuted for opening passenger doors in contravention of section 42 of the 1988 RTA. Perhaps the next time one of your passengers tries to exit in a hurry and in the process nearly causes an accident, you might remind them of the law.

The offence. Consists of opening or causing or permitting a door to be opened so as to cause injury or danger to any person. The offence can be committed by a passenger as well as the driver. If a child opened the door and his parent was present and knew the child was about to open the door, then the parent could be charged with permitting. If the child opened the door on the instructions of a parent then the latter could be guilty of causing the offence. Door opening, permitting or causing are all identical offences for the purpose of the penalties that may be inflicted. Only one of the offences should be alleged.

The prosecution does not have to prove carelessness; nor that someone was actually struck or injured. It is enough if the act caused danger.

I was on a School Contract and the escort let the child open the door it took my door off and peeled back the wing of a passing car. The council paid up (eventually!) and the escort got a written warning for not supervising the kid.
So really the escort got off lightly then?

Well I didn't, and a door of a vehicle owned by a member of this forum was damaged a month or so ago in that way.

Crazy thing was the scum mother and her family blamed the driver and he was the only one not at fault.
