I have a video of an outfit that operates unlicensed four door passenger vehicles in Manchester. Some might call it executive hire but considering that legally there is no provision in law for executive hire then they are operating unlicensed. I've given Manchester City council 48 hours to respond to my correspondence, if they don't respond then I'll make it available to the public within hours. Regards JD |

I suppose there is also no provision in law for special events licenses either but there are some councils that license limousines and other vehicles in this way. |

If they are licensed then they are within the law. There is no provision for so called executive vehicles provided with a driver to be unlicensed. Is there? Regards JD |

Manchester are entering into a period of consultation to best decide which way to apply this legislation ............ or at least thats what I'm led to believe. I would therefore suggest that your request will not be fruitful JD, but I would ensure that whomever you have on video is not compliant in the way you accuse ............... or it could get a bit messy. I understand that JD ............... but who will bring the case to court? The legal obligation to companies who carry the public, for hire and reward or not, is absolutely clear ................... but as the councils are the people charged with the enforcement of legislation, they need to be sure that IF they do decide to challenge a particular company that they are sure their activities will be found before the courts as being illegal. This legialation change covers everyone, from "executive hire" to childminders ................... its not always clear cut other than in specific circumstances ................... Manchester City Council, as far as I know, are consulting with "interested parties" so as to form their criteria of whom will need to become licensed and who will not ...................... and i'm concerned that its from people who were never intended to be effected by the legislation change that will set the case law But remember ..................... the vehicle and driver need to be licensed in the same authority as the operator has made provision to accept the bookings, so there may be vehicles and drivers working in a different area than they are licensed.
