Hi can you help? If a taxi driver gets a criminal record for common assault with battery will he lose his license. He is also under investigation for other issues but not yet charged. he has admitted to assault but not the battery part. He is an insult to all taxi drivers how can I get him removed from the road.

Hi can you help? If a taxi driver gets a criminal record for common assault with battery will he lose his license.

I can assure I do not intend to sling any mud. I am a very hardworking taxi driver who believes we are usually given a tough time however there are those out there who abuse the trust we have all built up. The person in question is in custody as i write this, the person he attacked was a young girl and she wasnt the first but he has managed to itimidate witnesses in the past . After speaking to the license officer again he admits he did not have all the facts and is now dealing with it as soon as the accused is sentenced in court. Due to the nature of the assault even though it is called section 39 it may now have to go to crown court. he has also been arrested on criminal damage charges. I apologise if I have upset any of you with the way I have worded my past comments unfortuenatly I also have a personal interest as The young girl is my niece.

Local media;careful you are not named and the story does reflect badly on your trade but on your licensing authority. Who knows,maybe the driver has 'connections' at the licensing authority,hence the inaction and to be careful not to be named.

Try your councilor or failing this your MP First though if you email the complaint to the licencing department, it will then be on record it is no good making a complaint in person What area are you in

Thank you for the sensible replies I have spoken to the license officer again sent an email and they are now dealing with it so hopefully he will be off the road very soon. Th local paper was also very interested. Much appreciation to all of you.

Thanks Its not your job to 'get' anyone removed from the road, the power sits with the local authority who I'm will sure treat your complaint with the seriousness it deserves. CC

The offence is now called Common Assault, or a section 29 or 39 offence. A conviction could apply to any touch including simply pushing someone out of the way. Doesn't even need an injury to happen. So back to your question the answer is, IMO, it doesn't always mean a conviction should automatically lead to a ban on being a cab driver. But in many cases it will.

I wonder about this, someone comes on a website and asks how to get a driver removed from the road based on errm basically asking....we dont have any actual report to go on (as if we're judge and jury), and it may even be malicious, indeed, even the council seem to be dragging their feet....for some reason....yet even in an age where in England even an allegation can see a driver suspended immediately? Capt taxi even mentions 'your trade' without knowing if the person making the post is a taxi person at all? and then goes on to mention 'connections', as if any LO will risk their job if someone has such allegations sitting over them (sorry but its true). Can I go any higher? errm yes, provide us with something stating a taxi driver has been arrested. The local paper was naturally interested, invariably they love the taxi trade! CC

as joining TDO doesnt require any proof of being a HC/PH driver anyone can join. disgruntled ex-WAG's, upset customers, anyone with an axe to grind, cross-pollenation from other non-taxi forums, etc, etc... lets rely on the "course of justice" as that is what we have in this country, innocent till proven guilty, in this case the LO/committee will have the final say no matter how much mud loulars slings

Your council is allowed to suspend a license with immediate effect if they feel the allegations are serious enough. CC

If the alleged offender is currently in custody then, IMHO, he is not an immediate threat. The council must tread very carefully when considering the suspension of a licence. They would therefore be sensible, in my view, to await the outcome of the court proceedings before taking further action. Certain court outcomes could give the council the opportunity to revoke a licence immediately with no further consquences. Job done. A different outcome in court may leave the council in a position where they can only suspend the licence pending a hearing by the licensing committee. This procedure would have to be followed for the council to avoid any accusations of unfairness and subsquent legal action. I hope I have worded this as a statement of my opinion. It is not my intention to be confrontational in this post. I would be interested to know the outcome of your efforts.

The taxi driver was found guilty today and it turns out he already had criminal record for common assault in 1993 1998 and 2006 he gets his sentence tomorrow. Thanks for all the advice given.
