Surveys are a funny thing but one thing is for certain, a council doesn't have to have one if it doesn't want one. Even if it did have one, it doesn't have to take any notice of it if the council wishes to deregulate. All a council need do is go through the consultation process and then change its policy. So I assume this judicial review which may or may not be granted is based on the fact that the council said they would have a survey and perhaps they even took additional licensing fees from license holders to cover the cost of the survey and then decided they would change their policy.
I think this solicitor they have must be wet behind the ears if she thinks she can reverse the councils decision at judicial review. I doubt they will even be allowed a judicial review but if they are and by some quirk of nature they win then the council will only go back and do it right. Presuming they have time that is?
I would like to see any evidence of the councils commitment to a survey, that would be most interesting presuming such evidence exists?
Does such evidence exist bubbles?
