Minicab Driver Jailed For Sexual Assault

20th September 2008

An east London minicab driver who sexually assaulted a drunken businesswoman who passed out in the back of his cab has been jailed for three years.

Kais Bougoussa's victim had spent the evening drinking wine with colleagues at a reception in central London before heading for her hotel.

The woman, who was later found to be three times the drink drive limit, promptly spotted the defendant's Mercedes and climbed in.

London's Southwark Crown Court heard that despite being licensed he had no right to ply for hire.

The woman`s last memory was "fiddling" with her Blackberry in the back of the cab before losing consciousness.

She eventually came round to find 39-year-old Bougoussa leaning over her, "pushing his groin against her and kissing her face".

Somehow the woman, who was in her mid-thirties and from Scotland, managed to push him off, get out, flag down a black cab and go to the nearest police station.

The defendant, of Cleveland Grove, Stepney, was later traced, arrested and convicted by a jury of one count of sexual assault last September.

Passing sentence Judge Peter Testar told him: "It seems to me what you did was to take advantage of your position as a taxi driver to exploit for sexual gratification a woman on her own in your car who was patently under the influence of alcohol."

He added that apart from having to register as a sex offender indefinitely, he would be subject to a five-year sexual offences prevention order banning him from "carrying for hire any unaccompanied woman or girl".

That's a new one on me.
Is this new legislation or have the courts always had this power?

So is this prevention order from the date of the sentence, the date of his release from prison, or the date in the future when he might again hold a minicab licence?

Because if it's either of the first two, it's not worth a light!!

Been around since 2003.

Five years is the minimum, so I can't really see why the judge didn't go for twenty or thirty years. :?

She "spotted his mercedes and climbed in",saw the roundel`s and thought ,there`s a taxi".Wouldn`t have happened if she "flagged down a black cab first"
does any one know if he lost his license?

Hard to take a license away pre-conviction, can't see him getting it back post-conviction.
