Taxi ranks
||Ashfield District Council have nine Taxi Ranks within its area.

They are situated at the following locations:

Sutton in Ashfield
■Market Street - On the left after the entrance to the shopping centre underground car park
■Fox Street - Adjacent to ASDA and Wetherspoons in the town centre
■Forest Street - Opposite the Crown and Woolpack Public House
■Iceland Car Park - At the side of the walkway from Priestic Road to ASDA
Kirkby-in-Ashfield
■Ellis Street - Outside the Shoe Shed
■Morley Street - Outside the Tanning Centre
■Co-op Car Park - On the exit road from the car park
Hucknall
■Market Place - Library side near to the pedestrian crossing
■Ogle Street - Outside Kitchen Creations
Ranks should be sited so that passenger safety is paramount and in order that passengers can alight and board the vehicles onto and from the footway on the nearside on the vehicle.

No vehicles other that Hackney Carriages (taxis) licensed with Ashfield District Council can stop on a taxi rank for any reason. The drivers of unlicensed taxis, or privately owned vehicles, found stopped or parked on any of Ashfield District Council taxi ranks are committing an offence and risk prosecution

Just to summarise.

1. The council have put conditions on a hackney carriage driver's license via the dual licensing scam. Yet no provisions in any act allows for dual licenses.

2. The council are collecting CCTV images as the only source of evidence against drivers, via an act of parliament brought in to fight terrorism. This act is currently being reviewed, and was trashed recently when used by a council to try and catch out people giving wrong addresses to get their children in better schools.

3. The punishment being given out by this council far outweigh any actual offence (if an offence has taken place). If the council are so outraged by this alleged over-ranking then there are provisions in a few acts that allow this to be brought before the courts, or allow the police to issue tickets.

This is as clear an abuse of power from a licensing department as any of us are likely to see. The jumped up, jobs worth officials that have arranged for the situation to get to where it is thoroughly deserve what the Tories are going to do to them.

It is highly unusual for you, Mr Sussex, to have your cage rattled to such an extent as to be so vociferous.

Thats true......but if 21 drivers have been suspended so far, surely its upto the 21 to make a stand.

Your honour, here is the 1847 act, here is the 1976 act.

The council have granted me a hire drivers license......neither act mentions this license.

Your honour, here is Wathan vs Neath Port Talbot.

This case proves a HC driver is governed by byelaws and not conditions.

The rule book is neither.

You will note the warning is addressed to a driver, yet it is the proprieotr of the vehicle who owns the taxi......how do the council know who was driving?

Your honour, here is section 52 of the Road Saftey Act 2006, here are extracts from the DFT on the issue.

I ask you if parking on double yellow lines is a 'serious' offence worthy of one months immediate suspension, I ask you if the government thought the Act would be used for reasons such as parking offences.

Tried them on that Trev, they wiggled out of it by saying they were using it for "OVERT" and not "Covert" purposes.

After reading the articles regarding the 14 drivers that have been suspended from working, each receiving a one month ban for over parking on a hackney stand, which was observed by using the councils CCTV which to the normal person would be a 30 to 40 pounds fixed penalty.

I was under the impression that to use CCTV in this way requires permission from the chief executive by way of RIPPA and only for anti-terrorist purposes, which it would seem over ranking now falls under that heading, the licensing team that advised the Councillors must now consider that they have played their part in protecting the general public from what they see to be a terrorist conspiracy.... I think we can all sleep peacefully in our beds knowing we have Jobsworths such as these.....PS Nigel what is your local paper.
