Men deny murder of cabbie who died seven months after attack

A driver who was stabbed in a ‘vicious and unprovoked attack’ died seven months later, a murder trial jury was told.

Anthony Leigh, 62, a grandad-of-six, picked up Nathan Livesey, 19, and Declan Fitzsimmons, 20, from the Bay Horse pub in Clayton Bridge, Newton Heath, in January last year and took them to Vale Street in Clayton, a court heard.

Manchester Crown Court was told Mr Fitzsimmons held a 12-inch knife to Mr Leigh’s throat and demanded his car keys. Mr Leigh told them that they would have to ‘kill him first’ and ran away, it was said.

But, the court heard, he was chased by Mr Fitzsimmons, who stabbed him in the stomach.

A witness helped Mr Leigh, from Audenshaw, back to his taxi where he collapsed in a pool of blood.

The jury heard Mr Livesey was leaning into the taxi and shouted at the witness ‘he shouldn’t have ripped us off’.

Mr Fitzsimmons, of Chesham Avenue, Wythenshawe, and Mr Livesey, of Shackleton Court, Newton Heath, deny murder.

Graham Wood QC, prosecuting, said the stab wound penetrated Mr Leigh’s spleen and kidney, forcing surgeons to remove both organs. He had dialysis before scans showed bladder cancer and a tumour in his lung.

He refused further treatment and died in a hospice in August 2009.

The jury heard the stab wound was a ‘significant and substantial cause’ of a chain of events that led to his renal failure.

Mr Wood said: “That stab wound was deliberately inflicted and gave rise to a series of medical complications which resulted in Mr Leigh’s death. In these circumstances, the Crown says both of these defendants are guilty of murder, Mr Fitzsimmons as a principal and Mr Livesey as a secondary party.”

The court heard that Mr Livesey did not wield the knife but was guilty of murder under joint enterprise laws.

Mr Wood told the jury: “Although he did not wield the knife, he is nevertheless guilty of murder by reason of his active and passive encouragement of Fitzsimmons in the attack, at a time when he knew he had a knife and when you can be sure that he foresaw the possibility that Fitzsimmons was intent at the very least on causing serious bodily harm."

“Their joint plan was to rob the taxi driver and to use violence to achieve this end.”

Two thugs face jail for the manslaughter of a taxi driver after a ‘vicious and unprovoked attack’.

The stab wound was a ‘significant and substantial cause’ of a chain of events that led to Mr Leigh’s kidney failure and death.

Nathan Livesey, 19, and Declan Fitzsimons, 20, were charged with murder but were found guilty of the lesser charge of manslaughter.
