The company i work (private hire) used to pay account money 2 weeks in areas,then in december it went to 3 weeks in arrears.We have been owed money from w/e friday 17th december due in the bank credit transfer friday 7th january,they have not paid us yet.No letters,no explanations,no communications.I asked office on mon 10th january when the money would be in,i was told "hopefully tuesday" It never went in,not in today either wednesday 12th january.I am owed over £400 with another payment of a small amount due friday 14th january.

The excuse being given by the company this morning wednesday was "we are waiting for cheques to clear from before christmas" This doesnt stack up,by my reckoning these would have cleared last wednesday 5th january roughly.This is not the first time this has happened,i am worried about doing account work that i may not get paid on,if the company was on the brink (overheads,staff,office costs choking it) and went under,would the drivers get paid first?

can only relate what i know....


my education (school runs) dept pay 14 days from invoiced, in fact decembers money went in on jan 6th, by transfer (cheques are dead), if a company owing your base has gone tits up your base may be hanging back to stay afloat, if your base is a ltd company your at risk of non-payment if they go under (they will of course restart/new name the next day)

thats NOT your problem, do you invoice the base and do you get a reciept for your base rent?

1 big base in brum has put rents up £3 per week "due to vat increase"

the extra vat was £2.50

As they owe you such a small amount, you can go to the small claims court. You can fill in all the forms online. Once served on the company they have 14 days, I think, or it may be 28 days to pay or respond. If they fail to respond you will automatically win your case and they will be issued with a CCJ. You can then get the court to seize goods to the value of the debt.
However they may be telling you the truth and payment will be made soon.

Of course if they have gone t1ts up, you will be at the bottom of the list of creditors. and will probably get nothing.

Thanks for the advice guys,the companies work has gone right down due to bad management,no marketing,poor controllers and company cars falling apart.There are mainly owner drivers and 10 maybe company cars,most of the work is account work hence my concern.Drivers are self employed and pay 20% commission on all work.Due to weight of drivers on other companies,competition and higher fuel costs,drivers are dropping out,retiring etc.This has been happening for the last 4 years in the area,i have a get out plan but am sticking with it for now.

Hopefully the money will be in by the weekend but the warning bells are ringing in my camp BIG TIME! The other companies in the area are all struggling,too many drivers.....

I will go down the small courts plan if the money doesnt arrive in the next 2 weeks as this route would be the final nail in the coffin

has any of the base's customers gone under recent, or has thier work stopped

id be worried

i got stung for £13k......that hurt

Most of it is airports and corporate stuff,drivers(2 or 3) owe thousands on cars,company cars are old and in the local garage for repairs constantly,his overheads are higher than the money coming in.

Hes always resisted radio rent instead of commission so many drivers in local area wont work for him,companies in a mess,id rather lose a grand than more than that.

In the local area even the hackneys are giving up at the local station due to weight of drivers,queues for their work getting bigger,more plates issued by council,higher fees,higher station permits,cost of fuel etc etc

All good fun..........

All I can say is don't do anymore contract work until they pay you. Our Contracts are paid out on the Monday when you've done them the week before so we don't have to wait. Sounds like the owner is trying to take everyones pants down.

on a circuit once, invoice monthly, get paid 14 days after the end of the NEXT month, i.e. work december, invoice 31st dec get paid 14th february

No invoices round here, you do a contract on the Sunday at 11:59PM it gets taken off the next day when you pay in. That's the way to do it IMO.

im afraid thats the case all over the country and its dog eat dog ,at crewe station the number of drivers and cabs as easily trebled with waiting times upto 2hrs for a job your lucky to earn £30 a shift off there but as soon as a local driver as to pack up because hes flogging a dead horse he is replaced with a member of the ethnic minority :oops: who recruits more friends and the numbers just keep on increasing ,im afraid just working off crewe station is no longer feasable ,to earn a days wage off there you have to work up to 16hrs a day which i was not prepared to do so i have kissed it goodbye ,im afraid its only going to get worse as councils and the government dont give a t##s about joe bloggs taxi driver ](*,)

Clearly the company has a cash flow problem, but if they are taking 20% then there is no good reason why they can't factor out the debt, and pay you.

Unless the outstanding debts are from customers who really shouldn't be allowed credit.

The firm looks iffy, and I suggest you look elsewhere. :wink:
