This all seems a little woolly. I know I'm the one asking the question but, so far, I've not been convinced there's anything wrong with the proposed action.

For instance, we have a rank at the local Asda and the trade generally 'queue up' outside the local navy base virtually permanently without apparent challenge.

Chances are, I've probably just answered my own question but how are you going to stand against me in a court of law and quote legal precedent to convict me?

There are drivers regularly booked in both Sefton and liverpool for illegal ranking.

I suspect this happens in many areas throughout the country, and it may depend whether there's a return to rank provision in the by-laws.

On the other hand, it may not be enforced anyway, for example due to a proper lack of rank provision and/or the fact that it's convenient for customers and/or helping clear the streets of drunks at night.

After all, we all know that it's illegal to park on double yellows, but there are private cars abandoned on them in towns and cities every night, an no one gives a monkey's.

'Booked' for what? Parking contraventions by means of a PCN under TMA 2004? FPN issued by police?

Just because there are yellow lines, it doesn't make the act illegal under HC/PHV legislation per se.

Very few PCNs will stand up to proper adjudication while, conversely,police FPNs are virtually impossible to defeat. But neither of them require us to return to a rank.

Why don't you get your council to do a review of ranking spaces, and get them to put ranks in areas that don't have them, but you want them?
