The priority for the Scottish government is to find a way to cap the numbers of phc licences, i have submitted my views and idea's on this, i recommend restriction through cost but not to the individual operators.

the complete things about this documentary seem suspicious to me, is it a copy to the latest tv show in Dublin about minicab. or it's a way to present the CEC and private hire companies...

The Minimum Wage from 01/10/11 is, as many have noted, £5.93 per hour.

However, as a refugee from the Catering Trade, I must pass on to you a piece of knowledge that is well known there and is often used in that Sector of the World of Work.

It is that an Employer can, quite legally, take your Tips into account when calculating your Hourly Rate of Pay and still be on the right side of the law.

In other words, if your Employer calculates that you have earned £40 in Tips during that 40 Hour Week, he/she is, quite legally, allowed to pay you £4.93 an hour and your Pay will be still be in accordance with the Legal Minimum Wage.

It is quite common, here in Ayr, for Drivers to be paid £5.00 an hour. For their Employer to be charged with paying below the legal Minimum Wage. The Driver would have to 'prove' that he was bringing in less than £0.93 per hour in Tips, on average.

Now, I'm sure that everyone here declares their Tips! But, even so, I'm sure that it would be quite difficult to prove that the average rate of Tipping was below that 93p per hour level.

Proof of tips, surely it's not your problem to prove what you don't earn to your employer. :?

In the Catering Trade there are said to be Employers who pay below £2.00 an hour, to some of their Table Service Staff. I have no proof of that extremely low Rate of Pay, but there is Chapter & Verse on Employers using this part of the Act to pay below £5.93ph.

If you want to go to the Tribunal and successfully complain about being paid beneath the Minimum Wage, you would need to prove, to the Tribunal, that you are not earning sufficient Tips to make your Hourly Rate up to the Minimum. Very difficult.

It just so happens that that is how the Act has been worded.
