The police reconstruction has no validity as the driver would be expecting to see someone or something on the road.

In order to carry ou the reconstruction, the police stopped one of our other Zafiras and told the driver to hand it over or bearrested for obstruction. I don't think the police are allowed to just take a vehicle from a driver unless it is a life or death situation. The incident happened at around 02.15 when most of the street lights are turned off and the reconstruction was done at around 22.45. He was interviewed by the police as a witness so he was not cautioned or informed of his rights. It was weeks later that they called him in and cautioned him and then charged him. The police advised him to plead guilty because it would probably be £100.00 fine and 3 points and nothing to worry about..............and the fool believed them.

Justice for the 96. It has only taken 27 years...........repeat the same lies for 27 years and the truth sounds strange to people!

Don't even know if the insurers will allow him to continue working for us yet. He has already lost his other job because he can't be insured on their policy. He may be called to a hearing by the Council yet as well. As far as I am aware the chap that got run over has not put a claim in yet. He has been seen out in town drinking again though.

The argument that I would also add to the above is; He looked but did not see! We have all been there whereby we have looked for (say) car/house keys, and not seen them although you/I have visited the given spot numerous times. I believe that there is a medical/psychological term for it.

I suppose that outside forces at work (what will be - will be)..........is out of the question

If called before the council he should show what the court said about how remorseful he was and is.

I think it has more to do with the guilty plea in my opinion. Even though I know that he only pleaded guilty because of the costs involved the fact remains that he has admitted that he drove without due care and attention or carelessly, which ever it was. For some insurers that would make him too much of a risk. The council may well consider him not fit and proper. Our insurers have told us that he can't drive until the underwriters have decided on his fate.

Why did the driver get charged?? It seems like we've got to have eyes up our backsides now and look out for p!ssed pedestrians who are a sleep in the middle of the road.

I'd appeal this to the Crown Court if I was the driver.

He can't appeal. The idiot pleaded guilty to keep his costs down. I tried to warn him what could happen by pleading guilty but he didn't have the money to fund a fight. The police "advised" him that a guilty plea would result in a fine of around £100 but if he pleaded not guilty and was convicted it would be far worse and could be £1,000. Add that to the cost of a solicitor and you can see why he didn't want to chance it.

Fines are basaed on income.

He would have had to have been earning £1000 a week to get that level fine.

No matter what he pleaded.

Never go on the advice of the Police, they're crooked as anything.

I know that and you know that, in fact after reading this forum, most people will know that but unfortunately this chap believed what the police told him and is now paying the price.
