I had a pretrial hearing today in relation to my hc renewal.

As my crb came through last friday the council is now prepared to issue me with my license and at the hearing they said that basically i should just let the case drop.

Obviously i want to reclaim my loss of earnings because of the council's actions but there is a question over whether the magistrates hearing is the place for compensation claims to be dealt with. Presumably I have to take seperate proceedings for loss of earnings.

the clerk of the court has given me 14 days to provide evidence that a magistrates hearing can deal with compensation cases.

Question is can the magistrates hearing award compensation (as opposed to costs) or do I need to take out other proceedings in order to recover them?

I would try and use the small claims court to re-cover your losses.

Administrative bodies such as councils are liable for negligence and not much else, so if you can prove your loss of earnings came about through the councils negligence then you may get some money out of them. Otherwise save yourself some heartache and perhpas a lot of money and swallow this one.
