The passenger you refuse.

No chance. The times I have tried to get passengers to make a legitimate complaint against drivers. (overcharging, improper behaviour, refusal to carry, etc. etc.) they never do, and I do not see why in this case, that they ever would. Unless you can produce case law to prove otherwise.

You will find the answers on TDO...if you care to look?

Go on, indulge me...

Remember this is Lincoln, though, home of the free thinker.

And this is what I think. On a taxi rank, the only cab plying for hire is the first cab, and therefore, any driver NOT first cab is obliged, (under City of Lincoln) bylaws, to direct intending passengers to the front of the rank. Any driver who takes a fare when not front cab does so in contravention of bylaws, which can only be amended by parliament. You can go into smug mode, now JD, and show me how wrong I am.

Statute law overrides bye laws and there is no law in the land that says a cab driver must send a punter to the first cab on the rank, but there is a statute law saying a cab driver can't refuse a passenger so you work it out.

Whoever thought that bye law up is a complete idiot.

Whilst the law might say the punter can take any cab usual etiquette would be to refer the punter to the front cab, usually that is enough.

We have one old man who gets cab's from the Romford rank who for some reason will only get in black cabs ( black as in coloured black ) Mines silver, I have known him to wait 30 mins for a black one to come along

We know in most areas its an accepted practice but accepted practices are not law and thats what matters.
