So this is only in Scotland! What happens if the guy in Scotland has this "emergency" and the job brings him into England?

Then he is legal.

Which does make a mockery of things. [-(

But this type of scam I believe led to the ending of the sec 75 contract exemption down here.

IMO when London got rid of their own little contract exemption scam in the 1998 Act it had to lead to the scam being ending throughout England and Wales, as the scamters could just do what they did in London just outside of it.

Maybe those MSPs in that big expensive palace up there will now help out the good guys by stopping the abuse from the bad guys.

But to answer your question IMO anyone with a Scottish PO Box could still get around English and Welsh laws. :?

It would appear you can do what you like in what you like as long as a proper written contract exists between you and your customer.

How do you know the contract has to be written?

I guess its governed by the point of booking..and as im in scotland it'd come under scottish rules...at last something from the scottish executive that doesn't grate on my nerves...

So you presumably didn't see the Executive's consultation on base station licensing a couple of years ago?

It's coming, but since they've been discussing it for years I wouldn't hold your breath in the meantime.

I daresay they'll close the 24-hour contract hire exemption as well sooner or later, to bring it in line with down south.

Just in case any SNP supporters are looking in I should have said that it's now the Scottish Government, not a humble Executive. [-(

Just a guess that your mob might read the law the same way as our mob.

And where could i Find such an Insurance for Occasional work only?? and How do these Luxury Limo guys manage to run vehicles that are unplated by any form of local authority, i assume that there is an Insurance catagory to suit them. as far as my Insurance brokers are concerned I seem to need every concievable authority proof before i get to insure any of my vehicles just short of getting a signature from the almighty himself tp say that I am who I say I am...

I don't know the precise answer to your questions, but there have been plenty of private cars used for occassional work in St Andrews over the years (eg for golf tournaments).

Tell your brokers that you would be using the car under the contract hire exemption under section 22(c) of the Civic Government (Scotland) Act 1982.

Had a quick read through Mr Sussex, and I can't see anything that might mean that a written contract is necessary, so could you point me to the relevant bit?

Anyway, the reason I ask is that there seems to be all kinds of rubbish floating around up here about what and what isn't involved in this exemption, eg if you were a chauffer's cap then some seem to think that means you're automaticially exempt.

Black. All sizes from 6 3/4" up to 8" at probably the best price in the country. £34.95 including VAT.
