Your original question should have been phrased, "can you sue the council ".

When you sue a business, corporate body, or any other such entity for negligence, you never sue the employee, its always the employer.

You wrote back, No.

Now if someone took that at face value, they would think that the answer ended any possibility of doing so.

If any of us is going to be of assistance to each other, then surely the answer should have been.

You cannot sue them directly, But! you can get to them via the "Chief Executive" which may or may not give you the desired result.

The point is, if a department is being negligent no matter which way anyone dresses it up, you can get to them via a court room.
