It doesn't surprise me in the least that yet again the facts of a case have been distorted by those who can't comprehend the legal system. Having said that the license should have been granted because the council had already refused the license. It would have been interesting to see how the court of appeal would have reacted to giving the council second byte of the cherry to refuse the license yet again just so they could dispense with the natural justice charge?

Tell me exactly what was won?

btw,

I didn't agree with the solicitor. I thought we had enough to risk running with it but he didn't think so.

I do agree however that this way when they fall there is no going back before the council, it's game over.

Maybe the clever ones (not in this case I may add) are the ones that get people to pay for them to represent them in court when they have no chance of winning.

I mean some of Edinburgh council's lawyers have gained retirement villas in Spain on the back of stupid councillors and officials. :roll:

I wasn't there and I wasn't there when Mackie made her unlawful decision either. It seems to me that Sheriffs in Scotland don't know very much about Taxi licensing law. Even Sheriff Principal Bowen wasn't that clued up because all he and every other Sheriff had to do was consider whether awaiting a survey was a valid reason for an extension? And they couldn't even do that so don't talk to me about Scottish Sheriffs because their track record is abysmal when it comes to Taxi licensing.

However, I can recall you laffing on the other side of your face only a few weeks ago, so I wouldn't get too optimistic about the outcome of this little scenario just yet.
