Post subject:  A controversial idea for inclusion in a new Cab Act

At the moment the law states that once a Hackney Carriage or Private Hire Vehicle licence is issued, it has to be renewed annually and cannot be revoked unless the proprietor is no longer ‘fit and proper’.

Perhaps the idea of a council not being able to tailor the numbers of licensed vehicles to the needs of their own licensing authority, should be more closely looked at.

For instance;

1. The ability of a licensing authority to issue temporary vehicle licences, so that they may be withdrawn and issued at the licensing authority’s discretion as the local needs dictate.
2. The prohibition of the transfer of vehicle licences from proprietor to proprietor, thereby truly making every vehicle licence the property of the issuing licensing authority.

Whilst I may agree that vehicles should not be sold with licences attached I can see why the council don't prevent it. I mean it's like selling a pub without a license to trade when clearly that isn't the case and isn't likely to ever be the case.

I'm not sure that fits in with the Human Rights act, in relation to property rights. Didn't the Royden judge say the license was property but not the premium.

That said, there are council(s) that have summer hackney carriage licenses, which I suppose would meet your request. Even if I do feel that to be illegal.

No I have not!!

One of the biggest gripes of the Bolshevik Apparatchiks that are amongst the ranks of the HC and PH brigades is the value of plates in restricted areas.

Get rid of that and the idea of limited vehicle licences for both HC and PH might become a possibility.

All anyone in this trade should be concerned about is to earn a reasonable living for reasonable hours worked.

Quite, but my point was what difference would it make to congestion and pollution if the driver of the withdrawn licence just goes and drives for someone else?

You can't cite free markets in support of letting councillors decide the level of supply in the market.
