I suspect from time to time those good people have a peep at TDO, and with that in mind I think we should pose some questions for them to consider.

I will start with one that has been alluded to by a number of posters on here.

1) Why, if the report indicates the PH trade is servicing punters better than the taxi trade, is it being proposed that PH standards are fixed by the government, whilst taxi standards set are by local councils?

2) PH vehicle standards are proposed to be fixed by the government. How on earth do the Law Commission think a national government is going to fix a national minimum standard for dents, carpet tears, fag burns etc etc? Or will any old shed be ok to license provided it has an MOT?

I have a question for the Law Commission...... are they being paid by the drug barons in this country .... because if they have their way...... they will have created the perfect route for supply and demand of this product......

The biggest problem the hackney and private hire trade have is the inability of licensing officers to interpret the law... they in turn guide their local councils, and the local councils solicitors back them up...... so I think it is only fair... that the Law Commission recommends strongly that solicitors be retrained to a standard of at least NVQ 2 in common sense.... and whenever questions are asked of the Ministry for Transport ( taxis section) their on stock answer is you will have to take it to court.... what is the point of this department....

5). Are the Law Commission the only body that thinks a council isn't suitable to require PH drivers to do a knowledge test, yet are suitable to fanny around with signage?

7 - Would the LC consider the penalty points system to be a good idea and put some strength behind them so a council can award points for overcharging,touting,poor vehicle quality,driver image quality, and general rudeness?

This would be so a council no longer has to go to court to remove constant offenders regarding illegally touting for work, the other things mentioned would be in house and subject to warnings, suspensions and finally removal of license if constant proven facts are attainable against the offending driver, i.e if it's overcharging and the customers have all the details by way of receipt etc the driver is warned then suspended and finally removed if he/she continues to rape the public wallet,

Also with touting, make the PH company pay a fine also if any of their drivers are found guilty (caught bang to rights) this will ensure all PH operators train they drivers to not do anything they aren't supposed to, incentive to play the game.

Bearing in mind that in urban hubs probably over 90% of licensed vehicle and licensed driver misdemeanours occur during the hour of the night-time economy, what enforcement powers do the Law Commission propose to appropriately deal with these transgressions, how would the new legislation ensure that enforcement officers are mandated to robustly tackle these outrages during unsocial hours and how would the new legislation enable enforcement costs to be adequately and properly funded?

Has anybody in the Law Commission given any thought to how this will affect insurance premiums, as premiums are normally set by where the driver will work, ie the insurance premiums for Sefton are different than Liverpool.

Have the Law Commission contacted the chief Constable's across England and Wales and asked them for their views, and maybe the local associations and national should contact them just to be sure... after all they will be the ones having to deal with most of the chaos that will be caused.

Could the LC please provide evidence of any other service industry that doesn't aim to provide a clear and transparent costing facility for its customers? If not why no meters in PH.

By not having clear signage on PH vehicles the public is put in unnessary danger and illegal touting encouraged. Could the LC please provide a valid justification for endangering the public.

Is the LC trying to create greater differentiation between the industry to avoid one tier.

Are the LC trying to create a two tier system based on budget and premium.
