The council seems to be acting incredibly harsh in this instance.

If the fella has been licensed since 2004, I'm assuming without incident, then just give the fella a temporary license until his DBS comes back.

I think the problem has been caused by the council previously only undertaking standard checks, whereas now they have realised that everyone else undertakes enhanced checks.
