DAILY MAIL (London)

October 12, 2006 Thursday.

HEADLINE: BLACK JUDGE TRAPS HER RACIST ABUSER

A WOMAN faced a barrage of racial abuse from a man who walked out in front of her car.

But "Lee Death's" target was determined he would not get away with it because she was Constance Briscoe, one of Britain first black female judges.

Death called her a '[edited by admin]' and a 'black c***' when he walked out into the road after an allday drinking session.

Mrs Briscoe, whose autobiography was serialised in the Daily Mail in January, called the police and tracked 27-yearold Death to a pub, where he was arrested.

City of London Magistrates' Court heard yesterday how Mrs Briscoe, 49, was driving past the Coach and Horses pub in Whitefriars Street in Central London last December 23 when Death stepped in front of her car.

Prosecutor Michael Otuyalo said: 'The complainant then heard the defendant call out through her half-open window: "You black c***". 'The complainant asked the defendant what he had said. He replied, "You f****** [edited by admin]".'

Mr Otuyalo said Mrs Briscoe told Death she was going to call the police. The prosecutor said: 'He (Death) replied: "Well, you called me a white c***" which she had not.'

Other members of Death's group, which included his wife and his brother, Christopher Death, shouted 'p*** off' and 'what's your problem'.

When Death and his friends tried to get into a cab, Mrs Briscoe told the driver she had been racially abused.

"The driver refused to let Death into his taxi and Death ran off". But Mrs Briscoe caught up with him in The Alibi pub in Shoe Lane.

Death, a legal messenger from Sydenham, South East London, denied racially aggravated threatening behaviour, but was convicted after a summary trial. Callum Haddow, defending Death, said he still refuses to accept responsibility and plans an appeal.

Court chairman Richard Walduck told Death: 'It was a very foolish thing to do. You don't need lectures on the dangers of alcohol. 'You were very fortunate to have so many friends to have written on your behalf. Don't let them down in future'.

Death was ordered to do 100 hours unpaid work and pay Mrs Briscoe £100 compensation. Mr Walduck said the compensation 'can no way reflect the damage done ñ it can only be regarded as a token'.

Mrs Briscoe's harrowing autobiography, Ugly, recounts her abusive childhood in South London. Her mother denies allegations made in the book and is suing her daughter and publishers, Hodder & Stoughton, to clear the family name.
