No it's not mitigation, it is a Defence.

The best thing Sudbury can do is go to a traffic specialist Solicitor who does the first half hour free and take his or her advice.

Plead Guilty and you then have costs going on and on with raised insurance costs year after year.

He could check whether he has Legal Fee access via his Bank Account (I do) or his household insurance (I do) or on any other similar things. Maybe if he has a separate car, the insurance may cover Legal Fees.

Lots of people have access to Lawyers they don't even know about.

The moral here is dont rent cars, dont trust base owners to tell the truth

ask for a copy of the insurance schedule and ring the company

I would think it is still the drivers responsibility to ensure that he was insured.
In this case I assume from what Sudbury states he was told he was insured by the proprietor but in hindsight should have asked for a copy of the insurance certificate.
The Council should be able to supply him with a copy of the certificate for the vehicle he was driving to see exactly what the cover was.
A lot of these certificates just state "any driver with the policy holders permission"

You can be self-employed and still entitled to worker's rights such as national minimum wage.

no, the bag was paying him, the base got their 60% last
