Surely the rule applies to everyone that commits a CU80 offence?
We have over 350 different councils with over 350 different sets of rules, but I suppose the question you are asking is should all drivers be treated equally, and the answer is yes.
Does the council have a set of rules and regulations, do those rules and regulations specifically state that offence leads to a 5-year ban? Did you, at the time, appeal to anyone about the severity of the punishment?
I would write to the Chair of Licensing about your concerns i.e. you have not been treated in the same manner as the recent case. Depending on his reply you could contact the Ombudsman.
It's too late to go to court, so don't threaten this that and the other, just point out in a reasonable manner that you don't believe you have been treated as fairly as the driver in the recent case.
