Well book it in, what have you got to loose? I can't see it having any effect on any potential future action, and you never know, a re-build may solve some of the problems.

:D Sorry I vanished from this site without an explanation again,some will say I have given in,but the reallity is that I have now escaped a deplorable situation that has over taken my life for 18 months.

I NO LONGER OWN LA56 GPK,AS THEY WOULD SAY AT AN EXECUTION, "PREPARE TO MEET YOUR MAKER"

I have a legal boot on my head and I am legally bound by a contract to : :lol: "not make or cause to be made(directly or indirectly any derogatory or critical or disparaging remarks,comments or statement)whether orally or in writing about the vehicle or the supplier or the manufacture,their associated companies or their respective offices or employees" :lol:

I fully intend to comply with my "legal obgligations on this matter " :sad:

I would like to thank the owners of this site for allowing me to air my situation,and to thank all respondents for any observations ,comments they have made ,public/trade support (LTDA ?) and understanding are fundemental in achieving justice !

I hope that no one has to suffer what I have endured for 18 months,but in the event ,would advise any one to remain commited in their belief of achieving justice,even if it is for a defective toaster !

You will all probably have noticed that "my site" and youtube have been removed as part of an agreement,sorry that my portrayal is no longer available,but to all concerned, remember that the internet can be a voice to the world !

I can now get my life back to normal, I wish I had £1.00 for every minute spent on this deplorable situation,or £1000.00 for every inch of the massive pile of paper work I have ! I now have a thorough understanding of our court system and presentation, that at the 11th hour was not needed !

Good Luck to you mate. Sounds like a moral victory to me. I'm about to start on Brit insurance, they've admitted to me (off the record) that it's more cost effective to let innocent customers take the blame for fraud, even though they know it's been committed, than prosecute the fraudsters. In talks with a production company's lawyers, as of next week.

:cry: Don`t laugh to much,gone back to a TX11,bought it before the Merc came on the scene, fingers crossed it actually seems to be a good one.I don`t have any on going issue with KPM we are quite amicable now,if I ever decided to buy a Merc there would not be a problem,or if I choose to use them for any other purpose.Life moves on, time to look ahead and learn a lesson from past events,I am sure you will all know what I mean :lol:

I just hope everyone else who emailed you with there problems, or bought one, does the same :D

It does seam strange that you have been gaged from informing folk though, freedom of speech and all that, can they legally do that??????, if it was me I would be shouting from the roof tops.
if the case did not go to court they cannot gag you as there is no court order in place, I dont think a judge would gag you either, and your free to carry on informing the public.
the only time you can be gaged is if you have signed the official secrets act

If it's part of the agreement you accepted then yes they can. Gagging clauses are very common. They don't want everyone else to know how much the deal cost them and they don't want their product to be slagged of any more than it already has been :shock:
If you don't like being gagged, don't accept the agreement.

Well I'm delighted with mine, as and when the timing chain tensioner starts slacking off I'll get it replaced. £350 every 2 - 3 years is'nt a lot.

That's half the problem with the Ford, drivers let them run and run until the chain comes through the front casing.

A bit like the drivers that save up all the niggly bits until the overhaul then look surprised when a 4 figure bill lands in their hand.

:sad: All I can say to all of you in the nicest way is that if you had been through my experience over the last 18 months,your only objective would be to escape the situation,without suffering a financial loss !This object was achieved !

The object in question cost me less than renting,I do not believe that I "won" !

If any of you have knowledge of the legal system I can assure you that my "exit" from this situation gave me the same result as a protracted court case,or better.

The Courts may agree with your case but it is their "decision" upon what you get.

Having now studied the law in depth it can be seen that in the event of any succesful court action ,the court will make a proportiant deduction for actual use ! This is often more than the actual claim!

The law does not work in favour of the victim which of course any major company is fully aware of. eusasmiles.zip

I believe I can hold my head high in this issue,I have always been 100% honest and correct.My life has been on hold,and I am glad to be out of it !

Please do not see my conclusion as a "Win", I think this whole situation is a "loss" to the cab trade and an example of how divided we are.I can say that I am glad I do not belong to any Trade Organisation,the several that I contacted and wasted my time with,while quickly pointing out that I was no longer a "member" did nothing to warn its members and protect their interests" eusasmiles.zip

I'm pleased you are satisfied with your outcome, but what has happened to the vehicle in question?

i.e. is another driver having the pleasure of driving it? :roll: :roll:
