how do you count "seats" when one is a large bench seat?....

does this count as one?

Firstly you count the seat belts, then there's a set space per person.

A seat is a minimum of 400 mm wide, although vosa seem to think that this is a maximum size. There must also be a flat space in front of the seat that is I think 300 mm x 300 mm. So the corners do not count as seats. There are a couple of other criteria as well but I can't think of them at the moment.

For assessing if a vehicle is suitable for X number of passengers a maximum size is required. Else some folks not caring to much will abuse the system and license great big hummers as eight seaters.

And we don't want that. [-X

That is the way you might want it Sussex but if you look at the rules there is no maximum size stated at all just a minimum.

you will be affected the same way as employed drivers are now, ie a max working week of 48 hours

it can be worked so you could do 70 hours + a week legally as you can with a HGV, but and it is a big BUT it needs sorting out before it comes in or we will be stuffed with a max week of 48 hours its up to the trade to get it sorted very quick.

If you just had a maximum size then you wouldn't have a minimum, therefore you could have umpteen folks in a vehicle suitable for far less than umpteen, and still be viewed as meeting the standard.

With a minimum size that can't happen.

Counting seat belts doesn't work either. There is no requirement for seatbelts on side or rear facing seats.

Which is why the vast majority of Limos are running unlicensed.

Apart from the drivers not being 'fit and proper'. :?
