Council To Appeal Over Private Hire Driver Case

A private hire driver who was given his licence back at appeal will have his case taken to crown court after Reading Borough Council argued the decision.

Shafiq Muhammed, 32, of Oxford Road in West Reading, had his licence revoked by the council after allegations of a sexual assault, but Reading Magistrates’ Court decided to award him his licence back after a full day trial on Thursday, August 14.

Sarah Bishton, council spokeswoman said: “Mr Muhammed’s private hire licence was revoked with immediate effect by the licensing application sub-committee on May 7 this year.

“Following this action by the council, Mr Muhammed decided to appeal to the magistrates’ court.

“Reading Borough Council has now appealed against the magistrates’ decision.

“As the magistrates’ court hearing has only just been concluded, it will be some time before a crown court hearing can take place.”

Manzoor Hussain, secretary of the Reading Private Hire Association, has said it will back Mr Muhammed in his plight and feels angered at the decision by the council.

The private hire association will be meeting next week to discuss the matter.

The council may win this one, then again they might not? It will be interesting considering there is case law that supports both sides.

The article says the sub committee "revoked" his license, the new powers were already in force.

ahh, I see that now, the allegations are obviously serious, I wonder if they took the badge straight away...as allowed in the new powers.

I don't know what the allegations amount to but obviously the magistrates thought they were insufficient to revoke his license.
