 Post subject: Witnesses Required

If any Edinburgh Taxi Drivers or PH Drivers witnessed me being detained, searched , breathalysed and generally abused by two and then three Lothian and Borders Police officers on Sunday morning on Queensferry Road at Buckingham Terrace could you send me a private message, one of these officers subsequently assaulted me so anybody that witnessed that part of it would be especially important as a witness.

Any help would be gratefully received, even just that you seen the TX4 with the Van behind it and the Mercedes Traffic car behind that?

I reported the assault at the Saint Leonards Police Station on Sunday morning but so far I've not heard anything, I get the feeling......you know how it works!

If you have reported the officers then their bosses had best look into your complaint.

If not report those bosses to the Scottish PCC http://www.pcc-scotland.org/making-a-complaint.aspx

I can assure you 100% the police will hate a complaint against them. :wink:

Stu, if you make a complaint against the Police you won’t get an instantaneous reaction, believe it or not there are hundreds of folks who make complaints on an annual basis, mainly scum bag criminals who hope it will aid their case when it comes to court when the defence lawyer can claim his client has had cause to complain. :sad:

It has to be referred to the Professional Standards (Complaints) Dept where a senior officer will look into the officers statements, your version of the events, any independent witnesses or CCTV footage, then make a decision based on what he has in front of him / her.

The process will take weeks, if not months.

Posting it all over forums and trade publications won’t hurry the process along, and as much as understand your anger at the events, patience will be required on this one.

Will do Captain but I think I have to wait until it goes to Court, since I hadn't done anything wrong really he decided to use the catch all charge of Breach of the Peace because according to him I had a bad attitude!

Apparently the Police will not do anything about an officer that assaults a working person until that person is either found not guilty or guilty of the malicious charges they have given them, well according to the Solicitor I spoke with today anyway.

I received the fixed penalty notice for £40.00 but never signed for it because I never done anything to breach the peace, I have therefore posted the slip to the Clerk of the Sheriff Court where the Procurator Fiscal has to get a Police report of the incident, they then try and get their story right and if they decide to go along with the Malicious charge levelled against me they fix a date at the Sheriff court for the trial.

I don't know if I'll drive a Taxi in Edinburgh again, I doubt it somehow, well done Lothian and Borders Police.

Anyone fancy buying an Edinburgh Plate and a five month old TX4?

I'll keep you posted Captain.

I gave a gentle toot of my horn at a car that was sitting next to the Police van at the traffic lights on Lothian road and the west approach road, the lights were at green and I had just picked up a passenger from the rank.

I didn't want to miss the lights and cost the passenger money, 25p every 45 seconds!

My highway code states that you should only use your horn while your vehicle is moving and you need to warn other road users of your presence.Never use your horn aggressively. You Must Not use your horn;

While staitionary on the road

When driving in a built up area between the hours of 11.30 pm and 7.00 am

Except When another vehicle poses a danger

Of course the when they stopped me they said the person in the car was asking for directions, quite how he thought I would have known that is beyond me, all I know is that I picked the guy up and mirror signal out into the inner lane to be met with two stationary vehicles sitting at a set of traffic lights which were at green. :?

Apparently giving a vehicle which is stationary at a set of traffic lights and obstructing the carriageway a gentle toot of your horn is reason enough for the police to drive at great speed through a busy town centre and ends up getting you a malicious charge for breach of the peace.

Sounds like the copper was a complete ar*e.....I home his next sh*t is an extremely huge one that leaves him needing stiches.

Stu, I know exactly how it works and you don't have a prayer but if you want to give it a shot

An Inspector will be assigned to take your complaint with a Police Sergeant accompanying. They will want you to give a verbal account of what happened - this is where you hand them a signed detailed account of your complaint in writing. They will attempt to solicit a verbal account to water down the detail - then get you to sign off on it.They do this to dissuade you from pursuing the complaint forcing them to submit your complaint before the Chief Constable.

They will say things like, "it is your word against the officers" and that they "believe you" but that "your complaint lacks any verifiable proof or an independent witness" -this is how they bury it.

If you do have anything on them they will ask, would be acceptable to you that they make a note of complaint on the officers records". This is how they make the complaint disappear. One less complaint for the Chief Constable to deal with - job done.

Insist that your complaint goes to the Chief Constable.

Think through what happened very carefully and detail everything. To start with look for any breach in Police Procedure.
