If the bookings are taken by a website in Malta, they may be beyond the reach of the 1976 act.

Anyone know what Maltese law is on this?

But the company has a base in England too.

That would only matter if the English base were accepting the bookings.
Doubtless the Maltese operation is an attempt to get round the law.

How about the 'making provision' part of the act?

I suppose it would depend on exactly what "provisions" if any are made by the English base. The devil will deffo be in the detail.

How hard can it be to collect evidence when they openly advertise surely you just book a taxi. Same as when the are collecting evidence that PH are picking up on the streets they go out and flag em down, it's not hard really is it

I think you'll find that.... advertising in itself is not enough.... and as for prosecuting pick-ups off the road..... you will find.. if you take the time to look... that prosecutions have been getting thrown out of court for lack of evidence since 1976 . in fact it is only in the last couple of years that they have managed to put together a system to prosecute which end's up in a conviction

So basically you can do it, it's illegal, nobody will care or do anything about it unless of course it's a news worthy read e.g wife of high up copper

You cynic!

How about a train passenger being killed in an illegally hired PHV?

Now that would be a good story.

It doesnt worry you that someone, who is answerable to nobody in particular, could make a decent profit from your service and efforts, and in the process potentially take over all the work you previously obtained yourself and then batter you for a price?
