As I see it, ownership of an HC is irrelevant. Anyone (even a PH :shock: ) can take bookings for a vehicle licenced under the 1847 act (or the 1982 CGSA, for that matter.) No licence is required for this activity.
Where it may be illegal is when that booking gets passed to a vehicle licenced under the 1976 act. This is a licenced activity.


I wouldnt be so certain about the 1847 bit.....the byelaws cover a driver and the proprietors license covers the proprietor......but someone completely unlicensed accepting a booking? I'm not so sure.....JD might be gonna help here I hope.

we havnt had money from fraser eagle since last oct ,a notice has been put up on crewe station stating this fact by crewe and nantwich taxi Association that they keep getting fobbed off by f/eagle and that all the replys are coming via malta,i wouldnt like to guess how much they owe all the drivers here, as far as im concerned they can stick there work where the sun dont shine ,the funniest thing about it all is fraser eagle run the permits for hire here ,come april i hope they dont want paying for the renewal of the permits as i can sence a big demo coming here ,virgin trains who operate crewe station should pull the plug on them,all the guys here are mainly owner drivers and many are on the brink of going under because of monies owed by fraser eagle ,i must also point out that most the drivers here are now refusing the ticket work and i dont blame them

We really need to know how wide spread this non payment really is. If anyone else is in a similar situation or has been in the past then we would like to know.

I know that whoever was covering the work in Penrith and Dumfries did stop doing the work late 2008 due to not being paid, I'm unsure what the situation is now, but I could find out over the next week or so.

How refreshing it was to read today in the latest Button book that he concurs with my legal opinion. :D

His view is that any firm that advertises the services of PH, including all these national booking agents, not only need an operator's license in the area where the phone/computer takes the booking, but cannot pass any work onto operators not licensed in the same district. 8-[

Chester Hackney Association have had some success in recovering monies owed.
They went and sat in the HQ in Bolton (I think) and said they were not leaving until they received full or part payment. My info is that a cheque for 4,000 was given, and since a further 7,000 has been paid.
If you go I would take a credit card machine with you.
