Then they are also acting outside of the 1976 act. :shock:


I know it's been on here before but can somebody upload that particular part of the 1976 act again please.

"operate" means in the course of business to make provision for the invitation or acceptance of bookings for a private hire vehicle;

"private hire vehicle" means a motor vehicle constructed or adapted to seat [fewer than nine passengers], other than a hackney carriage or public service vehicle [or a London cab] [or tramcar], which is provided for hire with the services of a driver for the purpose of carrying passengers;

Both of the above are interpretations laid out in the 1976 Miss Act.

So what I'm saying is those website adverts are invitations for bookings for private hire vehicles.

However if those adverts are invitations for hackneys or buses, then everything is ok.

But if the booking is carried out by a PH vehicle not licensed in the same area as the advert address (if the advertiser does indeed have a local operator's license), then that's IMO outside of the law.

There's a link on here in the Licensing & Legal for the 1976 act but it doesn't work. Is there another link I can go to for the info relating to the part of the 1976 act which in most peoples opinion makes this kind of thing illegal?

Yeah I don't know why that doesn't work, maybe it's been worn out.

Whilst looking for the bit I want I read this

hire vehicle invited or accepted by him, whether by accepting the same from the hirer
or by undertaking it at the request of another operator
, as the district council may by
condition prescribe and shall produce such record on request to any authorised officer
of the council or to any constable for inspection.


This seems a little contradictary to what I was thinking and now I'm having a full blown blonde moment. Could somebody interept it please

It's when they are from different manors they stray from the law of the land. :wink:
