But your in Scotland and the case is only of persuasive value?

I don't know Scottish law, there is a suggestion that what the case basically states could be rendered useless by a condition insisting the council metered rate should be displayed on the meter at the time of test.

However, it would appear to me that provided the meter at no point charges more than the table of fares....your LA is wrong....but then as I said I don't know and have very little interest in Scottish taxi law.

So basically the only way to find out if the case would be accepted, is for a company to test this out through the Scottish courts, unless there is an agreement somewhere in law that English court decisions are transferable

I wouldnt do that, I'd ask your council to point out to you which piece of legislation makes it illegal, then take it from there.

We dont have any by-laws here regarding taxis or Ph, the council always quote the 1982 bible when you ask them a point

There is only 1 in place and thats the age restriction, the rest are all under the 1982 act IE cleanliness and condition of bodywork, must have this and that to comply

Round our way we have some taxis with start rates set at £3.00 but including the first mile some starting at £1.60 and some at £1.80 but all charging about the same for a 1 mile journey and the punters moan and whinge and moan and whinge and moan and whinge and moan and whinge and moan and whinge and moan and whinge and moan about the cars whose meters start at £3.00 it doesn't bother them how fast the meter ticks up just what the meter starts on !

I wouldn't mind but all my drivers are on the £1.60 start but we have to listen to all the complaints about the ones that aren't Oh for the days when the fares weren't dergulated and all meters were set the same !
