That new hackney carriage proprietors’ licences are granted to licensed Reading
Borough Council Hackney Carriage Drivers who have been licensed and renting
Reading Borough Council licensed hackney carriage vehicles full time (at least 37
hours per week) for at least the last 3 consecutive years and whose intention it is
to personally drive the vehicle for which any licence is issued full time.
2.3 That licences are not granted to any person who has previously been issued a new
proprietor’s licence in the past by the Council, or to any person who currently
owns a Reading Borough Council licensed hackney carriage, or to any person who
has previously owned a Reading Borough Council licensed hackney carriage
vehicle and has sold or transferred the vehicle to another person within 5 years.
2.4 That hackney proprietors’ licences are not granted to persons whose spouse,
partner or close relatives hold hackney carriage drivers licences, where the
proprietors do not drive the vehicles themselves.
2.5 That new hackney carriage proprietors’ licences have conditions attached
requiring the following;
a) the proprietor must personally drive the hackney carriage full time (at least 37
hours per week) and in the event that the proprietor unreasonably ceases to
personally drive the hackney carriage in question full time the licence and licence
plate must be returned to the Council;
b) the proprietor shall rent the hackney carriage, at a reasonable market rent, to
another Reading Borough Council licensed hackney carriage driver so that it may
be driven for a second shift if another hackney driver seeks to rent the vehicle.
In the event that the proprietor refuses to rent the vehicle to be used for a
second shift the Council reserves the right to revoke the licence;
c) the vehicle may be sold at any time, but prior to sale the licence and licence
plate must be returned to the Council, whereupon the vehicle will cease to be
licensed;
d) the proprietor may transfer the licence to another appropriate vehicle, upon
application to the Council, provided he/she intends to continue to personally
drive that vehicle full time. The vehicle to which the licence is proposed to be
transferred to may not be older than the currently licensed vehicle.
2.6 Applicants who successfully meet the criteria and are eligible for a proprietor’s
licence must provide a brand new vehicle for licensing.
2.7 That successful applicants for the new hackney carriage proprietors’ licences be
required to take and pass the two part Council knowledge test and Driving
Standards agency driving test, if they have not already successfully done so,
within a reasonable time to be determined by the the Head of Environment and
Consumer Services.
2.8 Members note that it is intended that a further report be brought forward to
consider whether it is appropriate to introduce additional training/qualifications
for hackney carriage and private hire drivers.

I dont know about that old boy.....guaranteeing 37 hours per week over 3 years for a driver seems quite reasonable to me :lol:

To be honest I haven't yet read any of the reports but looking at the report posted by MrT I would be surprised if many of those conditions were actually lawful.

Having said that, if they are lawful then they make good reading for any local hackney trade who face removal of restrictions.

I have a feeling these conditions were at the behest of the Reading taxi trade and not the council.

Under the circumstances Stockport hackney drivers would probably die for most of these conditions.

Surely they can't make you rent out your vehicle can they. After all it's your vehicle and you would certainly drive it in a better manner than somebody else may do.

You know something? I think I made an error with this thread because it appears to me that the policcy change took place in February 2007.

You can pillory me now while I am still able to stand on two feet.

The odd part about this committee decision is that no one, in or outside of Reading, appears to have challenged the potentially illegal and perhaps somewhat oddball conditions, since they were introduced?

Apparently you can buy a cab off an existing owner but you can't get one from the council unless you can prove you meet the criteria.
