Very interesting, MCF.

How would you suggest amending that to cover the contingent charge of future legal costs?

Or, have you already covered it and I'm to thick to spot it?

IMO they can`t put money aside for court cases, they can only charge what it costs to run the licensing function, send the freedom of info letter in and see where your cash is going, I bet they have been making a profit year after year. Its only when they are challenged that they do things right, anyway by sending in the letter, will make them think your on to them.

Here is the response from my council for the information requested as above under the freedom of information.

I have forwarded this FOI request to the relevant departments and they are currently estimating the cost of providing this information.

You should be aware that if the cost exceeds £450 you will be given the opportunity either to pay for this information or to simplify your request.

The legislation provides for 20 working days to reply to this request and I will contact you again when either an estimate for the cost of the work is obtained or the information is ready for you.

Regards

If my memory serves me well fees are mentioned in the act and i think they have to be relative.

A council may advise a person or body submitting questions that in its opinion the cost of researching and answering a question(s) will exceed a given amount - £450 I believe. That is a simple answer and as you will imagine there are complicated rules. You need to ask questions in the right fashion b(simple to answer) to avoid them asking for a fee – which they can require up front. You could ask one question and get someone else to ask one and so on.
