We are in it for the long haul. The game is not won in the first 5 minutes. This was not unexpected but all part of the process.
There are a whole manner of cliche's that can be dragged up.

Now, let me see.

A demand is identified. The only reason a licence can be refused if there is no significant demand.

Methinks Cllr Keir has just broken the Law. I wonder whether a flagrant breach of the Law is a criminal offence. Certainly worth a look.

Cllr Keir is certainly corrupt. Whatever game he isplaying it doesn't involve political truth, honesty or any semblance of the alleged democratic political accountability we're supposed to enjoy.

Now we wait for two things. First the appeal. It was always going to go to appeal. The sooner the better.

And second? The second gentlemen is the next assault, rape or even murder. The sword of Damocles is hanging over Keir's head. It's only a matter of time.

Meanwhile, there is a stirring in the political process .....

yes changed my view in some ways and no i have not bought in and i have no intention of either.
my view is i just dont see why more plates should be put on the work is not out there right now and this would kill the trade forget the vested intrests stuff iam talking about the normal bloke who jockys his earnings would go down the pan

oh and another thing that helped was the constant insult and P1ss that jim posts that man is off his rocker big time.
i have no problems with others views as you dont with mine but i just cant stand the playground bully boy stuff.

i bet the insults will start soon

The CGSA is quite clear on this.
There must be No SUD for an authority to refuse a licence application. Proof of SUD is not required for a grant, proof of No SUD is for a refusal.
Refusing one without proof of No SUD is not in accordance with the act, and the application would most likely either be remitted back or granted by the Sheriff on appeal.

CEC have travelled this road several times now, and must be well aware of the requirements. so it could be considered deliberate flauting of the act. Whether that in itself is a criminal act, I will leave for others to debate. I'm just not sure.

Is there any case law on this?
