I have a conviction. Do I need to tell the council?

If you have a conviction, then this is normally something a council will want to know about and take into account when deciding if you are a fit and proper person to hold a license. The police can object to an application for a licence or its renewal.

An application has been refused. Can I appeal?

Yes, you can. Taxi Legal can advise on the merits of an appeal and the processes to be followed. Our team regularly deal with appeals throughout the country on behalf of licence applicants.

Do you provide advice on criminal law?

At present, Taxi Legal does not provide this service. However, we would be happy to refer you to a criminal solicitor if required.

How do I apply for a taxi operator’s licence?

Appropriate forms can be obtained from the relevant licensing authority (the local authority) in accordance with the Civic Government (Scotland) Act. However, there may be limited opportunity to acquire an operator’s licence in that way as the Act entitles a licensing authority to limit the number of licences and a number of licensing authorities use this power to limit the number of taxi licences issued.

Can a licence be transferred?

The Act does not permit an operator's licence to be transferred. However, licences can be held by business entities, for example partnerships or limited companies, rather than individuals. Ownership of the business can change.

What is the time-scale to complete a transfer?

It takes approximately three to four months for the application to be processed by the licensing authority.

Are there any risks?

There are significant risks for a party acquiring the interest in a licence, such as the possibility of a council refusing to grant an application.

What else should I consider?

1. The acquirer of a licence should be a "fit and proper person". The police will be consulted on the application and any criminal convictions will be a factor in the decision making.
2. Who is liable for any outstanding finance over the vehicle?
3. Is there any radio and computer equipment of a taxi association installed in the vehicle?

Delimitation will render the "investment" worthless.

Over 75% of local authorities have delimited taxis.

There is an active campaign to have taxis in Edinburgh delimited.
