Location: Royal Forest of Dean
Anyone come across this i have 12 points, ms90,lc20,cu50. Speeding, driving whilest my licence was revoked because i had not sent it off for points to be put on and i honestly knew nothing about it and unsafe load on a truck i borrowed. none of the convictions happened while driving a taxi, anyone any ideas...

You don't get points for trucks being overweight, but you do if the goods being overweight are unsecured or carried in a dangerous manner.

How could you not have known that? :?

That said, IMO you should get a lawyer/barrister to speak for you at the hearing with the council.

You are lucky not to be banned, never mind worrying about a taxi/PH badge...

CU50- I GOT 3 POINTS FOR INSECURE LOADON SMALLTRUCK EARLY 2009

MS90- DID NOT GIVE INFO OF DRIVER TWICE DUE TO INCOMPETENCE 2005 AND 2008

LC20 NO POINTS

DID NOT GET A BAN BECAUSE SOLICITOR TOLD ME TO PAY FINES AND NOT GO TO COURT BECAUSE YOU CAN ONLYBE BANNED BY ACOURT.

It would appear you only have 6 points currently. Points are only valid for 3 years and you can have them removed from your licence after 4 years.

Having said that, I'm not sure what your question is.

Question is- do you thimk there is any slim chance that my badge will be renewed and does anyone know of any similar cases that i can quote to the la to convince them that i would take them to court and win thus making it a waste of their money and time refusing.

I assume that you disclosed your driving licence points & convictions when you were last re-licensed.

The last thing you want to do is quote cases & try to 'convince' your licensing authority committee that refusing you a licence would be a waste of their time & money. Councillors & LOs don't like that kind of talk & your bottom line is to ensure you get re-licensed.

All re-licensing 'issues' are dealt with on an individual basis, with the relevant facts relating to that individuals application being taken into account & any policies that the council may or may not have that are relevant. So quoting other 'cases' is futile.

My advice would be, determine which emdorsements are still 'live' under the totting up proceedure, re-apply for your licence & see what happens. If they re-license you all well & good.

If they don't re-license you, don't get into any arguments with your LO or licensing authority committee; it will only make matters worse. You have to 'eat humble pie'. They didn't get the licence endorsements; you did. Always focus on the objective, 'getting re-licensed' & not arguing with those that may not want to re-license you.

You should be notified in wtiting of the reasons why you are not being re-licensed. In any event, as soon as you are aware that you are being refused re-licensing, you need to write to the council telling them that you are exercising your right to appeal to the Magistrates Court, consult a solicitor, or if you believe you are capable of doing it yourself go to the Magistrates Court & they will give you advice ON THE PROCEEDURE ONLY, NOT LEGAL ADVICE about how to appeal the council's decision not to re-license you.

The fact that the court has not banned you from driving is in your favour. And some years ago a Hackney driver in Brum was still licensed with ..... wait for it ..... 27 points on his licence.

But the most important thing is that you may be in front of your LO or licensing committee for determination of your re-licencing application. At all times hold your temper, be polite, listen to what is being said to you, & act in a manner that is not detrimental to your objective.

Good luck & remember you have a right of appeal to a Magistrates Court if your application to re-licence is refused.

I will be amazed if you are not re-licensed one way or another ..... unless you speak or act out of turn.

Well i went for the dont mention it approach, they took my licence to photocopy, i entered all the convictions on the application form and the nice lady took £95 off me and came back with my shiny new badge. also had to sign a DVLA mandate so that they will send the LA a copy of my licence to check that the licence i took over is up to date. So lets see what happens next. I checked with DVLA and points stay on your licence for 4 years and 3 of mine are due to come off in 4 days time.
