As a HC driver you are regulated via byelaws.....if your council wish to do this, arguably they can, but only by changing your byelaws.
Of course the other way they can do this is via HC proprietors licenses, which I think is totally out of order as a route to regulate drivers, but would need to be challenged via the courts.
I suggest you ask MCC for a copy of your byelaws and read Wathan vs. Neath Port Talbot which is on here somewhere or available via myself on email.
Byelaws must be approved by the DFT, and although such a byelaw is possible, its a more difficult route and I dont think your LA would have done it without the knowledge of the trade in Manchester.
You should be aware of a group called AGMA (association of Greater Manchester Authorities), they have complied a policy for all LA's in your area in respect of convictions.
I dont know if MCC has adopted it, I dont know if your reps in associations are aware of it......but they ain't NTA
