No PH can operate as a Hack.


Perhaps I'm missing your point but I see nothing in 21(b) which is being broken here. Anyone answering this ad will be prebooking their cut price trip.
Unless Mr Gaffney's private hire car or it's driver is not licensed by DCC?

BTW I think Mr Gaffney will be running around like a blue arsed fly for very little gain.
Maybe not! If he is constantly getting £67&8 jobs through the day even though he's losing a couple of quid on each one really all he is losing out on is a bit of extra fuel wheras in my case during the day you can be waiting around for 45 minutes to an hour and then end up getting a £2.10 job.

What if this numpty is sitting somewhere and is approached by a punter.Would it be okay for him to give him his mobile number then accept the job when his phone rings I think not.

But he isn't being approached by the public on the street, is he?
He's advertising his services in the newspaper. Any taxi or PH can do this perfectly legally in Scotland. The only thing I see wrong with this is he shouldn't have used the word taxi unless he actually has one, within the definition used in the 1982 act. (Cab isn't defined in the act BTW)
At best his ad is misleading.
Ask him to change it or contact the newspaper carrying it.

He's not operating as a taxi. Prebooked phone work is PH work.
IMHO he will go broke but he will do so legally.

All semantics, Joe public think he’s a taxi, He also does! Its just not the true definition of the word, but only 5% of ppl actually know that.
He is guilty of no more than using the same language as Joe Public. :wink:

which kinda tells you what he is.
a complete amateur,he probably doesnt know the diff between ph and hack either,one man band ,desperate ,if hes not signing on he will quickly learn the error of his ways.just trying to make a quick buck.
either way i doubt he,s worth having a song and dance about

They don't and are not required to by Scottish law.
We have one or two up here who do a regular contract or two and phone work off their mobile - mostly regulars.
All perfectly legit and cheaper than buying a WAV.
Wouldn't fancy it myself but it seems to work for them.

One man bands with a mobile are very common in rural areas.
Ask Skippy or Bloodnock.

if he hasnt got the word "taxi" on the card, or on his cards or letterheads, and he doesnt pickup unbooked fares off the street, whats he done wrong?

(subject to his LA regs, of course)

he is only using a mobile, when my LA dont allow me, but i can use a landline/skype/freephone diverted to me mobile......mental

In Kirkcaldy there is a Private Hire company with a fleet of about 25 cars who operate under the name of Taxi Central, their ads have such as 'Get Your Taxi on Time Not Sometime' and 'Kirkcaldy's Number One Taxi Firm'. The local lads have been protesting to the Council for ages and nowt is being done bit of backhanding going on with this Company and the Council is the wide belief as they have got away with loads of planning issues and are awarded nearly all Council contracts. :sad:

Sounds familiar , maybe ph should have a roof sign with fxck all hacks on it.We are getting shafted in dundee and the Boys who have invested in wavs deserve better inforcement of the law.

The numpty 5 pound ph is not helping the sitation.I personaly think he will lose money, i wonder how many blusers he has had already. :shock:

Very interesting, I didnt realise that! I think that it makes perfect sense, why need an office for just 1/2 vehicles! My word scotish law almost seems to make sense. I would have to pay out £800+ to get my one man band off the ground in N.Wales.
