I can't find the answer elsewhere, so forgive me for starting a new topic.

I understand the implications of the Liverpool case in that it was brought under DDA and Liverpool made no mention of a turning circle condition.

However, London and it's attendant legilslation specifically refers to the turning circle. I know that M-B now have the Vito that complies but, as far as I am aware, the E7 is not licensed for London. Is this correct?

Is it ever likely to be? Will a court judgement suffice for it to be? Is a complete change of legislation required before E7 can be licensed in London?

I'm in the middle of one of those silly pub arguments with, believe it or not, another cabbie!! As this thread develops, I'll send him a link to it!!

The Liverpool judge said that precluding the E7 from the Liverpool market was in breach of EU competition laws. IMO the turning circle doesn't come into it.

The mere fact that the PCO have the turning circle requirement means nothing if that condition precludes others from the market.

But, isn't the PCO condition cast in stone in parliamentary legislation?

Cab Direct are speaking to the PCO as we speak.

Whether the PCO (TFL) will allow it to be licensed without a fight remains to be seen, there are some stubborn individuals working up in the ivory tower in Penton St.

The LTDA were at the forefront of the campaign to allow drivers more choice during the last 'review' of the COF, they will be during this attempt too.

EU law takes precidence over UK law.

LTI have appealed the court case of Liverpool City Council and the E7 so maybe by the time this goes through the barristers maybe June would see the cab passed in Liverpool. London however is another matter. They will have LTI nibbling the ears of Dave Stock so maybe it will never be passed. Took yonks for a proper no smoking sign so a whole cab could take years. A choice is needed in London even if they don't want them but a choice is better than what we have now. A cab costing ten grand less might be a start but we can all dream.

Why have LTI appealed all they are doing is waisting money they don't have, its already been proven there cabs don't meet European disability laws
