When Fraser Eagle went to the wall owing the drivers £35K, and Virgin Rail subsequently allowed the phoenix company to take over the running of the operation, who subsequently went to the wall owing many people lots of money.

Do you think the drivers were wrong to refuse to do the work?

Cabfind, in so far as I am aware have only taken over this operation in the last month, according to a search they have assests of £15K, which is half the price of a TX but 100% of a Skoda, in respect of them illegally passing on PH work across district borders, do you think they are outside the scope of the laws of England?

If and when the DFT and Virgin Rail are contacted to advise of the legality of passing PH work across borders, in respect of Cabfind, do you think they'll go bust?

Cabfind give their Wirral address on their website, and a Liverpool address on the Whois database, so one has to wonder if they have PH ops licenses for both.

However they will also need PH ops licenses for all the areas they send work to, but I bet they don't.

Maybe the NTA or GMB should start asking questions. :?

Cabfind is owned by Davy Liver which will explain the Liverpool address and their offices are above their other company Wirral Satellite which will explain the Wirral address. It is the PH companies that have the licences and not Cabfind. It is suggested that it is money from the Wirral PH company that is subsidising Cabfind

You be lucky if they have any assets but if they do it'll probably be a couple of battered PH vehicles, but I could be wrong :wink:

Be that as it may, but have they got operator's licenses for all 400 (odd) councils in the country?

If not then they shouldn't be passing work outside of the areas that they do have licenses for.

I will remind folks exactly what the definition of what a PH operator does, i.e. operate, as is defined in the 1976 act;

in the course of business to make provision for the invitation or acceptance of bookings for a private hire vehicle;

Now it's as clear to me as the hooter on my face that Cabfind, whoever they are owned/run by, are making provision for the invitation or acceptance of bookings for private hire vehicles.

If they only use motors licensed by their base council, then everything is fine and dandy, but I bet they don't. [-X

Its clear to me that cabfind are leeching off the backs of the licensed trade.

It is also clear the licensed trade, provided they get the work and get paid, wont give a sh*t until such time as they (cabfind) do a 'fraser eagle'.

We have a company in Dundee who are about to get a Booking office licence on the 1st of April.They have cars that are Angus plated working out of a Dundee licenced booking office .Does anyone think this is wrong and why. :?:

I say because the office is more like a call centre that Angus plated vehicles can get work from a Dundee licenced office. :?

Scots law is different to the English variety.

If that was England you'd have the Shanks court case as proof it was illegal.

If they are HC's........then it maybe different.

Thanks Sussex the final conditions are not available yet when they are i will post them.
I am sure the trade asked for a condition that only cars licensed in our area could work out of the licensed booking office. I think this was removed at the offices request i am not sure why. I guess because this condition has been removed that they are not doing anything wrong.

This is the Statutory Instrument that relates to your booking offices.

It appears to me that licensed operators only need to ensure the driver has a license issued by the act, it doesn't say it needs to be one issued by the base licensing authority.

But it appears the local LO can look at all the records including the ones not relating to vehicles licensed by his authority.

TBH it's going to be a dogs breakfast, but at least it is one step forward.
