Tone, is there a condition which says that the licence holder must not ask a taxi driver to commit an illegal act?

It is the PH companies that have the licences and not Cabfind.

Be that as it may, but have they got operator's licenses for all 400 (odd) councils in the country?

If not then they shouldn't be passing work outside of the areas that they do have licenses for.

I will remind folks exactly what the definition of what a PH operator does, i.e. operate, as is defined in the 1976 act;

in the course of business to make provision for the invitation or acceptance of bookings for a private hire vehicle;

Now it's as clear to me as the hooter on my face that Cabfind, whoever they are owned/run by, are making provision for the invitation or acceptance of bookings for private hire vehicles.

If they only use motors licensed by their base council, then everything is fine and dandy, but I bet they don't. [-X

I don't disagree with you at all, in fact I've had many an argument over this very point, only to be told I'm wrong. In fact not only have I been told I'm wrong I've been called several names that would indicate I suffered with blonde moments :shock:

It is also clear the licensed trade, provided they get the work and get paid, wont give a sh*t until such time as they (cabfind) do a 'fraser eagle'.

How long will that be before they go belly up?? With assets of £15,000 they won't be long IMO.

Crewe and Nantwich taxi driver issue step closer to resolution

A TEMPORARY cap on issuing Hackney Carriage licences to taxi drivers is to be considered by Cheshire East Council.

Chief executive Erika Wenzel and Crewe and Nantwich MP Edward Timpson held a meeting on Friday to discuss growing concerns over the number of licences being issued in the area.

Along with the cap, Mrs Wenzel also agreed that the council would extend the current consultation on taxi provision in Congleton to cover the whole of Cheshire East, that a more wide ranging review would include looking at the terms and conditions of licensing as well as the number of taxi rank spaces available to licensed taxi drivers.

That's declared assets of £15,000. It's been gossip around these ways that the taxi company is bailing out the Cabfind side of things since it began some years ago. As to whether it needs to do that now I don't know. Last time I looked the Davy Liver companies seemed to be quite healthy

I hope you're wrong & that LAs that are saloon Hackneys or predominantly so at present, will only need to get to the proportion of WAV Hackneys to saloon Hackneys that is to be stipulated by the Minister.

How will they do that? :?

Proportions set by the Minister of State are part of the Equality Bill.

The way I read it was those LA's with 100% WAV fleets need not change, but those with saloon vehicles will be affected by the percentage.

From speaking with the DFT, thats the way they interpret it too :wink:

So who decides who pays £10,000, and who pays £30,000? :?

That's as may be & I don't doubt what you write.

But some time in the future when a Hackney driver in a 100% WAV area presents a saloon car for licensing, gets refused & takes it through the courts, who knows what might happen.

And I'm sure that some 100% WAV councils may even look at the idea of some saloon Hackneys in the future.

When all said & done the Equality Bill / Act seems to only legislate for wheelchair disabled.

What about the ambulent disabled, who would like to hire taxis at stands & in the street, but can't negotiate the high floor level of a WAV?

Don't they count as disabled people?

They may have drafted it & had a specific meaning to what they have drafted.

But you know who interprets statute when it comes before a court & it ain't those at the DfT.

They only have to use a slightly different word in a context & his lordship will view it differently than what was intended.
