The driver is 50 years old now & was 17 when he says he started driving a 'taxi', by which he might mean a PHV or car-for-hire. That would have been in 1977, when the LG(MP) Act 1976 was just being adopted by LAs. Prior to that everything went in the unlicensed 'car-for-hire' trade; I know I was in that 'trade' from 1973 myself until I was licensed PH in 1978, but soon learnt the errors of my ways & became a fully fledged Hackney in 1979.
You know the answer to this question yourself, you 'shrinking violet'; eight passengers is the legal Hackney limit.
According to Brian with a Y's League Tables, Stoke-on-Trent UA's rates are £3.00 for the first mile & £1.50 a mile thereafter. The AA route finder gives the mileage from Stoke Station to Alton Towers as 17.7 miles. So on mileage alone that would work out at £28.05 (maths NOT taximeter calculation). Even adding on say £1.50 for time charges along the way, the original driver would have over-quoted by about £5-7.
BUT is Alton Towers in the Stoke-on-Trent UA's Licensed Area? If not, & I don't know the area, then a quoted price could be given for the job.
Just one final point that is relevant to this situation &
all other similar situations throughout the country. The second driver is GUILTY of an offence under Section 64 of The Town Police Clauses 1847!!
Section 64 of The Town Police Clause 1847 states;
64 Penalty on drivers obstructing other drivers.
Any driver of any hackney carriage who suffers the same to stand for hire across any street or alongside of any other hackney carriage, or who refuses to give way, if he conveniently can, to any other carriage, or who obstructs or hinders the driver of any other carriage in taking up or setting down any person into or from such other carriage, or who wrongfully in a forcible manner prevents or endeavours to prevent the driver of any other hackney carriage from being hired, shall be liable to a penalty not exceeding [level 1 on the standard scale].
Amendment
Maximum penalty increased by the Criminal Law Act 1977, s 31(6), and converted to a level on the standard scale by the Criminal Justice Act 1982, ss 37,46.
So if it's done on you, make sure you have witnesses that are prepared to make written statements & get the barsteward prosecuted!!!
