tx_op the clue is in the words "Best Practice".

The Scottish government predicted what could happen if Best Practice was ignored. And it did, because the council ignored Best Practice.

Now consider a QC making a case for the victim who was assaulted.

M'lud, the government told the council what would happen, and it did. I submit M'lud that by failing to adopt Best Practice the council was negligent and my client suffered as a result.

The only question here is how much the victim would get. Do you doubt this tx_op?

However, there is also embarrassment for the Scottish government. Because the concordat it signed with COSLA agreeing not to interfere in council matters for the life of this Parliament made it "advise" rather than control or lead.

And a victim suffered because the Scottish government failed in its duty as the governing authority to ensure public safety.

This just cranks up the damages award for the victim(s).

Do you doubt this also tx_op?

Seems our governing authorities are in something of a fankle.

My only problem here is that I don't know how to contact the victims to tell them.
