Hi guys

I am representing myself against my local authorities decision to refuse an application for a taxi operator license.

They currently limit the number, and I am appealing as I believe they had no right to refuse under the Civic Gov Act, due to the decision being based on historical unmet demand survey evidence. As you may know, authorities can only refuse if they believe there is not significant unmet demand, and if they have no evidence supporting this view they must grant. The committee based their decision on a survey over a year old which surely is historical, and anyway, the Court of Session has determined demand must be that based on that at the time the committee hears an application, adding in Coyle v City of Glasgow Council, all that is required is that the matter should be kept under review by an official who has the information to judge whether the demand has increased since the matter was last considered, there was no such evidence from any official at my hearing.

I believe I have a good chance of success, but may need help with the procedural side of court business. I managed the summary application okay

Thanks in advance

There is a saying that he who represents himself in court has an idiot for a lawyer and a fool for a client. BEWARE.

Lawyers say that, and they are right, partly.

However, if you hire a fool for a lawyer, you have a fool for a lawyer. And most lawyers are fools and all you're doing is paying some idiot a lot of money to f@@k up your case for you !

The Courts are here to serve us, not the other way around imho

there was no such evidence from any official at my hearing.

And Salteri.

Which is an interesting one the council lost even though no-one in court spoke against them.

Apart from the Lord that is. :D
